There are different types of custody determinations that must be made in all divorce proceedings. The first type is "shared parental responsibility" which consists of both parents making the decisions together with regard to extraordinary health, education and religious issues involving the children. Therefore, if the parents are granted shared parental responsibility of the children they will share the decision making responsibilities with respect to these issues.

The second type of custody is "primary responsibility" which refers to the location where the children will reside. The parent with primary physical custody will have the children living with them for the majority of the time and making the daily decisions regarding meals, bed time, bringing them to school and other daily activities.

In determining custody the Courts look at what is in the "best interests" of the children.

Custody disputes and change of custody after the final divorce hearing can be very expensive and difficult on the children. It is important that if you are seeking a change of custody with your children that you find a family law attorney you are very comfortable with and someone who will fight for your custody rights.
